Racing/Stunt Driving

This is the newest kid on the block. This charge is being heavily enforced for Toronto traffic tickets and Ontario traffic tickets as a method of combating highway fatalities. Being charged under this section will result in an immediate 7 day suspension of your licence, the car you are driving towed and impounded and upon conviction 6 demerit points, a fine of $2,000 to $10,000 dollars, a two year licence suspension and even jail time or both.

Cell Phones

Let me tell you about these nasty puppies. A cell phone is 3 points on your licence. A $600 to $1,000 fine in the courtroom. A three day driving suspension of your licence that shows on your driving record. And YES, a possible cancellation of your insurance policy. We have had several clients in 2020 that have come to us because the insurance got cancelled because of a cell phone conviction. Why not come to us FIRST?

Driving Under Suspension

On a first offence a fine of $1,000 to $5,000 plus an automatic six months additional suspension of your driving privileges. On a second and any conviction thereafter a fine of $2,000 to $5,000 and even jail time. This is a very technical defence and there is a paper trail that has to be tracked. We do all this for you.

Stop Signs and other Sign Charges

Stop signs and other sign charges carry demerit points ranging from 2 to 3 points, depending on the charge. Again, simply stating “I didn’t notice the sign” or that it was a new sign and “I am not familiar with that area” will not help you at trial. We win most trials simply by listening to the evidence against you and looking for flaws in the evidence. If you don’t know what to listen for, you will be convicted. And we can save all the points on these.

Red and Amber Light Charges

These charges carry 3 demerit points and again, unless you know what you are doing, these charges are difficult to beat. Most people are not even aware you must stop for an amber light or a right turn red light! These trials are technical, involving testing procedures by the Officer and distance/time factors versus kilometers per hour in order to win. We can save all the points on these.

Speeding Charges

Speeding is an absolute liability offence. There is no excuse in law to speed. Reasons like “there was an emergency, my child had to go to the bathroom” or “I was late for a very important meeting, on the way to the hospital” mean nothing in court. It is a very technical trial that should not be attempted by anyone other than a professional. Demerit points on speeding charges range from 3 points to 6 points.

Careless Driving

This charge is considered a “blanket charge” and is used by Officers mostly for accidents. It is a very serious charge that carries 6 demerit points. It is also possible for a suspension up to 2 years, even jail time or both! It is the second most serious charge in the Highway Traffic Act and a conviction will result in your insurance being cancelled. We take a very thorough look at this charge when we are hired.

Fail to Remain

This is one of the most serious charges in the Highway Traffic Act. On conviction you are liable to a fine of $500 to $1,000, 7 massive demerit points, possible fine and jail time and two year license suspension or both.

No Insurance

On a first offence the minimum fine is $6,250 with a possible suspension of your license. A second offence incurs an increased fine of $12,250 dollars.

Fail to stop for police

On conviction you are liable to a fine of not less than $1,000 to $10,000, 7 points, imprisonment for not more than six months or to both fine and imprisonment.
